Selling counterfeit items requires the authorities to prove that you knew the items were fake. A person could buy fake bars, be none the wiser, then go to sell that at some later stage and be accused of doing something illegal.
Dont know if this guy who got arrested knew they were fake but this bit from the news story does not go well for his defense: "Edmondson is accused of also exiting the "officer's patrol car and fleeing on foot while handcuffed and under arrest," according to the indictment"
